| Judge’s Decision in Grant’s Case Due in August |

People’s Action Movement (PAM) Leader Lindsay Grant will have to wait until August to know if his election petition against Hon. Glenn Phillip will go to trial.
BVI Judge Indra Hariprashard-Charles informed on Thursday that she would be rendering her decision in August as to whether the case would proceed to trial or if Grant’s petition struck out.
Representing Grant in the election petition challenging Phillip’s victory at the polls, Attorney Terrence Byron argued that the issues put forth in their submissions deserved a court hearing.
“The Constitution stipulates that you vote only in the Constituency in which you reside. Votes which were cast by people who do not live in Old Road were therefore not good and valid votes. This is a Constitutional imperative and the Constitution is supreme,” he said.
Grant’s petition also names the Electoral Commission - Hesketh Benjamin, William Dore and Myrna Walwyn - and the Supervisor of Elections Leroy Benjamin Sr. The PAM leader, who lost the election by some 29 votes, is charging the group with bribery, voter fraud, and other election infractions.
Senior Counsel Anthony Astaphan said he is confident in the team’s presentation, and has no doubt that the judge will strike out Grant’s application.
Grant, however, is convinced of his team’s success in putting their case forward.
“I am confident my legal team's arguments were well-grounded in the law and equally confident that the Judge will see the corrupt nature and immensely fraudulent activity that seriously skewed the results in my constituency in the last general election,” he said.
No specific date was given for the Judge’s ruling. However, it is expected to be handed down in late August before the new Assizes opens in September. |
